1. GENERAL PROVISIONS
1.1. This Agreement (hereinafter referred to as the Agreement) applies to the site of the Advanta Tool Factory located at https://svp.advanta.ua/ and to all relevant sites linked to the site svp.advanta.ua.< /p>
1.2. This Agreement regulates the relationship between the Site Administration Advanta Tool Factory (hereinafter - Site Administration) and the User of this Site.
1.3. The site administration reserves the right to change, add or delete clauses of this Agreement at any time without notifying the User.
1.4. Continued use of the Site by the User means acceptance of the Agreement and changes made to this Agreement.
1.5. The user is personally responsible for checking this Agreement for changes.
2. DEFINITION OF TERMS
2.1. The following terms have the following meaning for the purposes of this Agreement:
2.1.1 Advanta tool factory - a site located at the domain name svp.advanta.ua, which operates under using the Internet resource and accompanying services.
2.1.2. Online store - a site containing information about the Goods, the Seller, which allows you to choose, order and (or) purchase the Goods.
2.1.3. The administration of the Internet store site is the employees authorized to manage the Site.
2.1.4. The user of the Internet store site (hereinafter the User) is a person who has access to the Site through the Internet and uses the Site.
2.1.5. The content of the Internet store website (hereinafter - the content) - protected results of intellectual activity, including graphic, textual, photographic, derivative, component and other works, user interfaces, visual interfaces, trademark names, logos, computer programs, databases , as well as the design, structure, selection, coordination, appearance, general style and location of this Content, which is part of the Site and other intellectual property objects, all together and / or separately, contained on the Internet store site.
< b>3. SUBJECT OF AGREEMENT
3.1. The subject of this Agreement is to provide the User of the Internet Store with access to the Products and services provided on the Site.
3.1.1. The online store provides the User with the following types of services:
• access to electronic content on a free basis, with the right to download, view content;
• access to search and navigation tools of the online store;
• providing the User with the opportunity to post messages, comments, user reviews, rate online store content;
• access to information about the product and to information about the purchase of the Product on a free basis;
• other types of services (services ), which are implemented on the pages of the online store.
3.1.2. All existing (actually functioning) services (services) of the Internet store are subject to this Agreement, as well as any subsequent modifications and additional services (services) of the Internet store that appear in the future.< /p>
3.2. Access to the online store is provided free of charge.
3.3. This Agreement is a public offer. By accessing the Site, the User is deemed to have joined this Agreement.
3.4. The use of materials and services of the Site is regulated by the current legislation of Ukraine
4. Rights and obligations of the parties
4.1. The site administration has the right to:
4.1.1. Change the rules of using the Site, as well as change the content of this Site. The changes come into force from the moment of publication of the new version of the Agreement on the Site.
4.1.2. Restrict access to the Site if the User violates the terms of this Agreement.
4.2. The user has the right to:
4.2.1. Get access to use the Site after meeting the registration requirements.
4.2.2. Use all services available on the Site, as well as purchase any Goods offered on the Site.
4.2.3. Use the Site exclusively for the purposes and in the manner provided for in the Agreement and not prohibited by the legislation of Ukraine.
4.3. The Site User undertakes to:
4.3.1. To provide, at the request of the Site Administration, additional information that is directly related to the services provided by this Site.
4.3.2. Respect property and non-property rights of authors and other rights holders when using the Site.
4.3.3. Not to take actions that may be considered as disrupting the normal operation of the Site.
4.3.4. Do not distribute any confidential and protected by Ukrainian legislation information about individuals or legal entities using the Site.
4.3.5. Avoid any actions, as a result of which the confidentiality of information protected by the legislation of Ukraine may be violated.
4.3.6. Do not use the Site to disseminate information of an advertising nature, other than with the consent of the Site Administration.
4.3.7. Do not use the Internet store site services for the purpose of:
4.3.7. 1. downloading content that is illegal, violates any rights of third parties; promotes violence, cruelty, hatred and (or) discrimination on racial, national, sexual, religious, social grounds; contains inaccurate information and (or) insults directed at specific persons, organizations, authorities.
4.3.7. 2. incitement to commit illegal actions, as well as assistance to persons whose actions are aimed at violating restrictions and prohibitions in force on the territory of Ukraine.
4.3.7. 3. impersonating another person or a representative of an organization and (or) community without sufficient rights, including employees of this online store.
4.3.7. 4. misrepresentation regarding the properties and characteristics of any Product from the online store catalog posted on the Site.
4.3.7 . 7. incorrect comparison of the Goods, as well as the formation of a negative attitude towards persons who (do not) use certain Goods, or condemnation of such persons.
4.4. The user is prohibited from:
4.4.1. Use any devices, programs, procedures, algorithms and methods, automatic devices or equivalent manual processes to access, purchase, copy or track the content of the Site of this online store;
4.4.2. Disrupt the proper functioning of the Site;
4.4.3. By any means bypass the navigation structure of the Site to obtain or attempt to obtain any information, documents or materials by any means that are not specifically provided by the services of this Site;
4.4.4. Unauthorized access to site functions, any other systems or networks belonging to this Site, as well as to any services offered on the Site;
4.4.4. Violate the security or authentication system on the Site or any network belonging to the Site.
4.4.5. Reverse search, track or attempt to track any information about any other Site User.
4.4.6. Use the Site and its Content for any purpose prohibited by the legislation of Ukraine, as well as incite any illegal activity or other activity that violates the rights of the online store or other persons.
5. USE OF THE INTERNET STORE SITE
5.1. The Site and the Content included in the Site are owned and managed by the Site Administration.
5.2. The content of the Site may not be copied, published, reproduced, transmitted or distributed in any way, as well as placed on the global network "Internet" without the prior written consent of the Site Administration.
5.3. The content of the Site is protected by copyright, trademark law, as well as other intellectual property rights and unfair competition laws.
5.4. The purchase of the Goods offered on the Site may require the creation of a User account.
5.5. The User is personally responsible for maintaining the confidentiality of the account information, including the password, as well as for all activities, without exception, conducted on behalf of the Account User.
5.6. The user must immediately notify the Site Administration of unauthorized use of his account or password or any other violation of the security system.
5.7. The site administration has the right to unilaterally cancel the User's account if it has not been used for more than a number of calendar months in a row without notifying the User.
5.7 . This Agreement applies to all additional provisions and conditions for the purchase of Goods and the provision of services provided on the Site.
5.8. Information posted on the Site should not be interpreted as a change to this Agreement.
5.9. The site administration has the right at any time without notice to the User to make changes to the list of Goods and services offered on the Site and (or) to the prices applied to such Goods for their sale and (or) services provided by the Online Store .
6. LIABILITY
6.1. Any damages that the User may incur in case of intentional or negligent violation of any provision of this Agreement, as well as as a result of unauthorized access to the communications of another User, are not compensated by the Site Administration.
6.2. The site administration is not responsible for:
6.2.1. Delays or failures in the process of carrying out the transaction, which occurred as a result of force majeure, as well as any case of malfunctions in telecommunications, computer, electrical and other related systems.
6.2.2. Actions of transfer systems, banks, payment systems and for delays are related to their work.
6.2.3. Proper functioning of the Site, in case the User does not have the necessary technical means for its use, and also bears no obligation to provide users with such means.
7. USE OF PERSONAL DATA
7.1 We use various technologies to collect and store information when you visit the site. This may include the recording of one or more cookies or anonymous identifiers. We also use cookies and anonymous identifiers when you interact with services offered by our partners, such as advertising services.
8. Resolution of disputes
8.1. In the event of any disagreements or disputes between the Parties to this Agreement, the submission of a claim (a written proposal for voluntary settlement of the dispute) is a mandatory condition for going to court.
8.2. The recipient of the claim, within 30 calendar days from the day of its receipt, notifies the applicant of the claim in writing about the results of the consideration of the claim.
8.3. If it is impossible to resolve the dispute voluntarily, any of the Parties has the right to apply to the court for the protection of their rights, which are granted to them by the current legislation of Ukraine.
8.4. Any claim regarding the terms of use of the Site must be filed within the term after the grounds for the claim arise, with the exception of the protection of copyright, which is protected in accordance with the legislation of the materials of the Site. In case of violation of the terms of this clause, any claim or grounds for a claim are extinguished by the statute of limitations.
9. ADDITIONAL TERMS
9.1. The site administration does not accept counter proposals from the User regarding changes to this User Agreement.
9.2. User reviews posted on the Site are not confidential information and can be used by the Site Administration without restrictions.
